If we are looking for an Ur-explanation for the persistence of the Ur-myth, or any other myth, in our literature, could we not more directly find it in the structure of a mind which does not have to remember in order to imitate? The occasion of both myth and literature is the social life of the species which, in Starobinski's sense, is a history of continual eviction; but as regards the apparatus of thought by which this social life is reflected (...) in art it is more a history of assimilation and repetition. "The work of the brain," to cite a recent article in Scientific American, "is to create a model of a possible world rather than to record and transmit to the mind a world that is metaphysically true…Different worlds are presumably constructed by similar species."1 And, presumably, similar worlds are constructed by similar species. Weisinger hints briefly at something like this in his essay "The Mythic Origins of the Creative Process," but one has the clear impression, as his title suggests, that he would like to have the [myth/ritual] cart before the creative horse.2 However much this may satisfy our longing to crown our literature, if not creativity itself, with a mythic genealogy, it seems a wistful hypothesis. It compares a traditional interpretation of Hobbes where Hobbes’ use of conventional terminology when talking about natural law is seen as ironic or merely convenient despite an atheist viewpoint, with the view that Hobbes’ morality is truly traditional and Christian. The book considers other thinkers of the age in tandem with Hobbes and discusses in detail his theology inspired by corporeal mechanics. Explainable AI (XAI) provides methods to understand non-interpretable machine learning models. However, we have little knowledge about what legal experts expect from these explanations, including their legal compliance with, and value against European Union legislation. To close this gap, we present the Explanation Dialogues, an expert focus study to uncover the expectations, reasoning, and understanding of legal experts and practitioners towards XAI, with a specific focus on the European General Data Protection Regulation. The study consists of an online questionnaire and (...) follow-up interviews, and is centered around a use-case in the credit domain. We extract both a set of hierarchical and interconnected codes using grounded theory, and present the standpoints of the participating experts towards XAI. We find that the presented explanations are hard to understand and lack information, and discuss issues that can arise from the different interests of the data controller and subject. Finally, we present a set of recommendations for developers of XAI methods, and indications of legal areas of discussion. Among others, recommendations address the presentation, choice, and content of an explanation, technical risks as well as the end-user, while we provide legal pointers to the contestability of explanations, transparency thresholds, intellectual property rights as well as the relationship between involved parties. Three issues related to Feldman and Levin's treatment of biological variability are discussed. We question the usefulness of the indirect component of δλ. We suggest that trade-offs between speed and accuracy in aimed movements support identification of δλ, rather than λ, as a control variable. We take issue with the authors' proposal for resolving redundancy in multi-joint movements, given recent data.

Doctoral programs at U.S. universities play a critical role in the development of human resources both in the United States and abroad. This volume reports the results of an extensive study of U.S. research-doctorate programs in five broad fields: physical sciences and mathematics, engineering, social and behavioral sciences, biological sciences, and the humanities. Research-Doctorate Programs in the United States documents changes that have taken place in the size, structure, and quality of doctoral education since the widely used 1982 editions. This (...) update provides selected information on nearly 4,000 doctoral programs in 41 subdisciplines at 274 doctorate-granting institutions. This volume also reports the results of the National Survey of Graduate Faculty, which polled a sample of faculty for their views on the scholarly quality of program faculty and the effectiveness of doctoral programs in preparing research scholars/scientists. This much-anticipated update of such an essential reference will be useful to education administrators, university faculty, and students seeking authoritative information on doctoral programs. For many years, moral philosophers have been debating the conceptual and moral status of the distinction between intending harm and foreseeing harm. In this paper, after surveying some of the objections to the moral significance of this distinction in general, I focus on the special case of state action, arguing that whatever reasons we have to be suspicious about the distinction's moral significance in general, we have very good reasons to believe it lacks intrinsic moral significance when applied to (...) state action. After arguing for this claim, I pursue in a preliminary way some of its implications. (shrink)

MacIntyre’s ‘liberal’ view of the state’s toleration of hate speech may seem surprising given his radical rejection of liberalism. It appears liberal because MacIntyre agrees with some classical liberal conclusions, as formulated by Locke, concerning the requirement of evaluative neutrality of the state. This seems to be the main reason why MacIntyre argues that the hate speech toleration at the governmental level should not be ‘content-based’, i.e. it should be strictly ‘context-based’. The paper argues that MacIntyre’s ‘context-based’ approach (...) seems problematic because it does not take the relevance of different political contexts seriously enough and should be modified towards the ‘regime-based’ model, in which hate speech bans are justified only by the insufficient quality of a given democratic society. Coping with assessment tests are known to generate anxiety frequently in the students who face them. In academic circumstances with the continued presence of emotional disturbance, high demand, and stress, emotional and physical fatigue, typical of burnout syndrome, and can be detected. Anxiety and burnout are related to each other and even more closely in high-stakes tests. One of these tests is the examination imposed in Spain for access to the university. The objective of this work is to analyze the (...) presence of anxiety and burnout and the relationship between them in students who face these tests, both during the confinement situation due to the COVID-19 pandemic and during the pandemic after the lockdown. For this purpose, we used a sample of 1,021 students with a mean age of 17.89. Of these, 866 were students who were taking the test, while the rest were university students who had passed it recently. Our results show high levels of anxiety and burnout in students who face the evaluation test during the COVID-19 pandemic, sustained over time and especially in comparison with students who had already taken the exam. The association between higher levels of anxiety and higher levels of burnout in the students who take these exams was also verified. These results link the relationship between these two variables more solidly and suggest the need to include address anxiety to reduce burnout levels in these students. The _Xing Zi Ming Chu_ 性自命出 (_Nature Derives from Decree_) is one of the eighteen pieces that were recorded in Guodian 郭店 bamboo slips, which were excavated in 1993 and thought to be buried around 300 BCE. We can observe from this text detailed discussions surrounding terms such as _xing_ 性 (nature), _qing_ 情 (emotion), _xin_ 心 (heart-mind), and _yue_ 樂 (music), which played crucial roles in producing early Chinese philosophical discourses, particularly in the area of moral psychology. Since its (...) publication in 1998, this text has gained huge interest from Chinese scholars. This article illustrates how Chinese scholars, through their concrete studies, reveal the complicated textual nature of the _Xing Zi Ming Chu_ and its intricate relations to different philosophical streams which followed. This article also points out a problematic assumption that lies in the majority of Chinese scholarship and proposes a more sensible approach to examine this text. (shrink)

지금까지 국내외를 막론하고 교회와 국가의 관계에 관한 역사적 논의, 특히 독일관념론 시대의 논의와 연계하여 이들 양자를 키에르케고어가 과연 어떻게 바라보았는지를 다룬 연구는 미흡하다. 나아가 이 논의를 키에르케고어의 이론철학, 곧 지식과 믿음의 관계에 대한 논의와 연계하여 다룬 경우는 거의 없는 실정이다. 이 논문은 이와 같은 문제의식 아 래서 키에르케고어의 국가-교회론에 관한 주장을 그의 지식-믿음론과 연계하여 살펴보고, 이어서 이를 독일관념론, 특히 헤겔, 칸트, 셸링의 국가-교회론과 연계하여 살펴볼 것이 다. 이를 통해 그의 종교-정치론이 오늘날 현대사회에서 지니는 의의를 모색하고자 한다.

Franz Rosenzweig (1886-1929) is one of the most significant German Jewish philosophers of the twentieth century. Published in German in 1920 and now finally available in English for the first time, Hegel and the State is a major contribution to the understanding of Hegel's political and social thought and a profound analysis of the intellectual currents that shaped the German state in the late nineteenth and early twentieth centuries. Through careful readings of Hegel's early handwritten manuscripts, Rosenzweig shows (...) that Hegel was wrestling with the problem of how to reconcile the subjectivity and freedom of the individual within a community and ultimately the political state. According to Rosenzweig, the route out of this conundrum chosen by Hegel shaped his mature political philosophy, where he saw the relationship between the individual and the state as reciprocal. At a deeper level, the significance of Hegel and the State lies in the way that Rosenzweig explains the failure of Hegel's quasi-communitarian view of the state to emerge, due to the authoritarian direction of the newly-unified German state under Bismarck. Anticipating the political and moral disaster that was to follow, Rosenzweig concludes by questioning the very viability of any theory of the state that relies on the pillars of bureaucratic militarism and a government-supported capitalist business culture. With the inclusion of a Foreword by Myriam Bienenstock and a substantial Afterword by Axel Honneth, Hegel and the State is a ground-breaking work of early twentieth-century philosophical and political thought. It is essential reading for students of Hegel, German Idealism, Jewish philosophy, and the origins of critical theory. Anarchists standardly critique the state for being illegitimate, and for being dominating in some sense. Often these criticisms come as a bundle: the state is illegitimate because it is dominating. But there are various stories we might tell about the connection between the two; domination makes consent impossible, domination means that the state fails to meet its own justification for existing (or for claiming authority), and so on. I suggest that we should sidestep concerns about consent: in (...) part because it seems possible for people to genuinely consent to something which is nonetheless impermissible, but also because many anarchists offer views of political organisation which very clearly involve some coercion of rule-breakers – Malatesta, for example, explicitly endorses the exclusion of persistent non-compliers. Rather, I argue that the best way to understand why the state is illegitimate – and a way which is immanent in many anarchist critiques – is to combine something like a Pettitian analysis of domination with a requirement that genuine authorities (and authoritative imperatives) recognise us as agents and treat us accordingly. On this view, states are necessarily dominating in virtue of two key features: dominating in virtue of being able to exercise arbitrary power over agents, necessarily so because part of what it is to be a state is to be an institution which exercises (and refrains from exercising) power in virtue of morally arbitrary features. As a paradigm case, states must be able to exclude non-citizens, on pain of losing their successful claim to a monopoly on legitimate force. But to recognise somebody as an agent is inconsistent with denying them access to territory or services on the basis of something as arbitrary as their place of birth. This analysis also explains why it’s possible to hold that all states are illegitimate, but some are nonetheless “better” than others – depending on the structure of a state and the power held by its citizens, we may be more or less vulnerable to arbitrary interference, and hence be more or less dominated, in one state than another. In a bid to boost fertility levels, Iran and Japan have recently launched their own dating apps, with more countries likely to follow. The aim of this article is to consider whether state-run dating apps are morally desirable, which is a question that has not received any scholarly attention. It finds that such apps have at least two benefits that collectively, if not individually, render their introduction to be welcomed provided certain conditions are met. These benefits are that they (...) are better placed than commercial dating apps such as Tinder, Bumble, and Badoo to (i) help people find lasting love and to (ii) protect individuals from spending too much money and/or time on online dating. Several objections are discussed and shown to be unconvincing as arguments against state-run dating apps tout court, including the objection that for states to offer their own dating apps is unduly expensive; the objection that it gives them too much power; and the objection that they should invest in creating offline opportunities for meeting potential partners instead. Over the past decade, a flurry of media stories devoted to sports-related concussions have drawn attention to the previously “silent epidemic” of traumatic brain injury in athletes. From 2001 to 2009, the annual number of sports-related TBI emergency department visits in individuals age 19 and under climbed from 153,375 to 248,414, an increase of increase of 62 percent. Multiple head injuries place youth athletes at risk for serious health conditions, including cerebral swelling, brain herniation, and even death — postconcussive conditions (...) that have collectively been referred to as “second impact syndrome.” Studies have shown that children and teens — and girls, in particular — are more likely to sustain a concussion and have a longer recovery time than adults. Recent research also suggests that even subconcussive hits in children and adolescents may result in longer-term health effects such as decreased cognitive functioning, increased rates of depression, memory problems, and mild cognitive impairment. After years of the welfare state, the rise of technology, combined with neoliberal governmental apparatuses, has established a new society of the precarious. In this new way of the world, productivity is not just connected to labor in the traditional sense of work hours, but more totally, to the formation of the self: work becomes performative and affective, and personal identities seep more and more into working ones. This new mode of being has another side, however: it can lead (...) to new forms of self-organization, resistance and exodus. Despite recent empirical interest, the links between optimism and pessimism with pro-environmental behavior remain equivocal. This research is characterized by a reliance on cross-sectional data, a focus on trait-level at the neglect of state-level optimism–pessimism, and assessments of retrospective self-reported ecological behavior that are subject to response bias. To attend to these gaps, 140 North American adults were experimentally primed with bogus optimistic or pessimistic environmental news articles, and then asked to report their levels of state optimism–pessimism, intentions (...) to purchase green products, in vivo PEB, and support for geoengineering technologies. Results confirmed that optimistic environmental messaging enhanced the expression of state optimism, which then contributed to PEB and support for geoengineering. These results have important implications for the framing of environmental messaging intended to promote ecologically conscious behavior. (shrink)

Liberal egalitarians tend to be committed both to generous asylum policies and generous, universal welfare states. Yet there may be political, social and economic reasons why there is a conflict in realising both. Asylum seekers may create economic pressures to the welfare state, or undermine national solidarity supposedly necessary to support redistribution. In this paper, I discuss how political theorists should approach these empirical concerns. I take issue with the view that theorists can simply move between ‘realism’ and ‘idealism’ (...) by accepting more or less of reality. Instead, political theorists should seek to offer a critical description of the conflict, which can reveal structures of power that ought to be subject to normative scrutiny. To this end, I discuss two accounts of how the welfare state may justify asylum restrictions in relation to the case of Sweden, a universal welfare state that has recently introduced restrictions on asylum to protect the welfare state. I argue along these accounts that the welfare state is both an important source of political and social order and a foundation of the personal moral experience. Yet a critical analysis also illustrates how these claims weaken as underlying methodological nationalism and bias towards existing power structures are brought to light. Asylum restrictions cannot be justified if they contribute to perpetuating these power structures, which cause some of the conflict with the welfare state in the first place. (shrink)

Virtually every figure in the climate justice literature agrees that states are presently failing to discharge their duties to take action on climate change. Few, however, have attempted to think through what follows from that fact from a moral point of view. In Climate Justice Beyond the State, Lachlan Umbers and Jeremy Moss argue that states’ failures to take action on climate change have important implications for the duties of the most important actors states contain within them – sub-national (...) political communities, corporations, and individuals – actors that have been largely neglected in the climate justice literature, to date. Sub-national political communities and corporations, they argue, have duties to immediately, aggressively, and unilaterally reduce their emissions. Individuals, on the other hand, have duties to help promote collective action on climate change. Along the way, they contribute to a range of important contemporary debates, including those over the nature of collective duties, what agents are required to do under conditions of partial compliance, and the requirements of fairness. Targeted at academic philosophers working on climate justice, this book will also be of great interest to students and scholars of global justice, applied ethics, political philosophy, and environmental humanities. The aim of this article is to bring to the attention of the international nursing community the discrepancy between a pervasive ‘caring’ nursing discourse and a most unethical nursing practice in the United States. In this article, we present a duality: the conflict in American prisons between nursing ethics and the killing machinery. The US penal system is a setting in which trained healthcare personnel practice the extermination of life. We look upon the sanitization ofdeathworkas an application of healthcare professionals’ (...) skills and knowledge and their appropriation by the state to serve its ends. A review of the states’ death penalty statutes shows that healthcare workers are involved in the capital punishment process and shielded by American laws (and to a certain extent by professional boards through their inaction). We also argue that the law's language often masks that involvement; and explain how states further that duplicity behind legal formalisms. In considering the important role healthcare providers, namely nurses and physicians, play in administering death to the condemned, we assert that nurses and physicians are part of the states’ penal machinery in America. Nurses and physicians (as carriers of scientific knowledge, and also as agents of care) are intrinsic to the American killing enterprise. Healthcare professionals who take part in execution protocols are state functionaries who approach the condemned body as angels of death: they constitute an extension of the state which exercises its sovereign power over captive prisoners.
